Scottish Parliament requires lenders to take all reasonable action to prevent mortgage repossessions

In February the Homeowner and Debtor Protection (Scotland) Bill was passed by the Scottish Parliament. The Bill requires that all repossession cases except those were the property has been surrendered voluntarily are now heard in court and that lenders demonstrate to the court that they have taken all reasonable action to prevent repossession. The Bill also allows for lay representatives to provide people with greater assistance to present a defence. It is now awaiting Royal Assent
